The debate over Native Americans’ rationality and its influence on the bull Sublimis Deus (1537) and the Laws of the Indies (1530-1542)

Between 1530 and 1542, the laws concerning the slavery of Native Americans, as decreed by the Spanish crown, underwent significant changes. In a span of merely twelve years, Charles V initially prohibited slavery for just war and ransom in 1530, later permitting it in 1534, and subsequently reinstated the prohibition through the New Laws of 1542. In my research, I endeavor to elucidate the evolving nature of Spanish legislation during the 1530s-1540s, rooted in the intense debates surrounding the rationality of Native Americans at that time. This period saw significant discourse, with even Pope Paul III engaging by issuing the bull Sublimis Deus on 2 July 1537.

En apenas doce años, Carlos V prohibió la esclavitud por guerra justa y por rescate (1530); la permitió de nuevo (1534); y volvería a prohibirla en las Leyes Nuevas (1542). En mi investigación he tratado de explicar la naturaleza cambiante que presenta la legislación indiana durante las décadas de 1530-1540 a partir del intenso debate acerca de la racionalidad de los indígenas americanos que se produjo en esta época, en el que acabaría interviniendo incluso el papa Paulo III con la expedición de la bula Sublimis Deus, el 2 de julio de 1537.
