Based on a hitherto neglected body of documents, the files of the Oberste Justizstelle, this interdisciplinary study examines the judicial practice of criminal law by the Habsburg monarchy’s supreme court in the Vormärz period, shedding light on the historical forms of criminality and deviance in Tyrol and Vorarlberg. It provides a differentiated analysis of the sentencing practice of the Oberste Justizstelle and its interactions with lower courts, revealing aspects like the Viennese judges’ stereotypical perceptions of the population in the ‘Italian part of Tyrol’. The book combines traditional methods of (criminal) legal history with innovative approaches from the history of criminality as well as discourse analysis, allowing it to contribute to the history of Austrian criminal law, criminality as well as social history, providing insights into the everyday world of the first half of the 19th century.
