Spanish Abstract: Este trabajo analiza la estructura de un juicio penal que aconteció en 1570, durante la tercera expedición para conquistar la lejana y salvaje provincia de Costa Rica. Se concentra en el procedimiento mediante el análisis comparativo de los documentos del juicio así como varias fuentes jurídicas castellanas, incluyendo manuales y tratados procedimentales, que datan desde el siglo XIII hasta el XVII. A través de este prisma, este trabajo también aborda el debate atinente a la continuidad o ruptura de las prácticas judiciales entre el reino de Castilla y las Indias, en el que entran en juego la especificidad del Derecho Indiano y la idea de un orden jurídico atlántico.

English Abstract: This paper analyses the structure of a criminal trial which took place in 1570, during the third expedition to conquer the faraway and savage land of Costa Rica. It focuses on procedure by cross-referencing the trial’s documents and several Castilian legal sources, including procedural manuals and treatises, dating from the thirteenth to the seventeenth century. Looking through this prism, this paper also engages the debate pertaining to the continuity or disruption of legal practices between Castille and the Spanish Indies, in which the specificity of the Derecho Indiano and the idea of an Atlantic legal order come into play.
