Comodato (DCH) (Commodate (DCH))
No. 2020-19
The commodate was a type of contract through which the owner of an object granted it to another person, free of charge, for a specified use and a certain period of time. The only condition was that, upon completing the agreed-upon objective, the loaned object had to be returned. Aspects discussed in this paper include the types of objects that could be granted in commodate, the persons who could grant and receive those objects through this contract, the obligations of the parties involved, the consequences in the eventuality of the lost of the object, and the legal actions that could be interposed.
