15th Investment Arbitration Moot Court

For the fourth time, the Max Planck Institute for legal history and legal theory is hosting, together with the international law firm Aurelius Cotta, the Frankfurt Investment Arbitration Moot Court, the oldest and most prestigious student competition in the area of investment protection law.

This year’s case is based on the historical dispute between the Roman publicani and the City of Priene in the Kingdom of Pergamon (today’s Güllübahçe in the Province Aydın) dating back to the period of the Roman civil wars (130 BC to 30 BC). Due to the fragmentation of the sources, the real reason for the historical dispute cannot be reconstructed anymore, however, but for the purpose of the Moot Court, it is assumed that the dispute was over whether the salt pans in Priene were covered by a concession agreement. Although the historical case was ultimately decided in favor of the City of Priene, for the purpose of the Moot it is assumed that the publicani invoked investment arbitration under a fictious codicil in the will of the King of Pergamon and an equally fictious treaty between the Roman Republic and the Kingdom of Pergamon.

Participating student teams will prepare pleadings for both sides and then compete against each other in several rounds. The victorious teams in the early rounds will move on to the next round, until the two final teams compete in the decisive pleading to determine the overall winning team. The final will take place on June, 30 at 2 pm at the Max Planck Institute for legal history and legal theory. If you would like to attend the final pleading, please contact gebhart@lhlt.mpg.de.
