Spanish Abstract: La apelación es un instrumento del Derecho procesal. Se trata de un remedio procesal, un recurso que puede usar quien no ve satisfechas sus pretensiones tras finalizar el pleito, para que acudiendo a otro juez la decisión del primero sea revocada o confirmada. En cada ordenamiento jurídico las reglas que regulan este recurso determinan qué decisiones pueden ser objeto de apelación, ante qué juez debe hacerse y en qué tiempo y modo; además el resultado de la apelación tiene unos efectos determinados. En este trabajo se estudia el funcionamiento de la apelación en el Derecho procesal canónico tal como quedaba regulado en los territorios de Hispanoamérica y Filipinas. La apelación suponía el recurso al juez superior y era frecuente que en estos territorios la distancia que separaban los tribunales de primera y segunda instancia fuera grande. Es lógico que, para que quienes acudían a la justicia en estos lugares pudieran apelar, se establecieran reglas excepcionales, que evitasen los problemas de acceder al juez superior y así facilitar el ejercicio de este derecho.

English Abstract: The appeal is an instrument of procedural law. It is a procedural remedy, a recourse that can be used by those who do not see their claims satisfied after the end of the lawsuit, so that by appealing to another judge the decision of the first judge can be revoked or confirmed. In each legal system, the rules that regulate this remedy determine which decisions can be appealed, before which judge it must be made and at what time and in what manner; furthermore, the result of the appeal has certain effects. This paper studies the functioning of the appeal in canon procedural law as it was regulated in the territories of Spanish America and the Philippines. The appeal involved recourse to the superior judge, and it was frequent in these territories that the distance separating the courts of first and second instance was large. It is logical that, for those who sought justice in these places, exceptional rules were established to avoid the problems of accessing the higher judge and thus facilitate the exercise of the right to appeal.
