On October 5, the institute will host Daniel Bonilla Maldonado to discuss his latest book “Legal Barbarians, Identity, Modern Comparative Law and the Global South”.

In this novel and unorthodox historical analysis of modern comparative law, Daniel Bonilla Maldonado explores the connections between modern comparative law and the identity of the modern legal subject. Narratives created by modern comparative law shed light on the role played by law in the construction of modern individual and collective identities. This study first examines the relationship between identity, law, and narrative. Second, it explores the moments of emergence and transformation of this area of law: instrumental comparative studies, comparative legislative studies, and comparative law as an autonomous discipline. Finally, it analyzes the theoretical perspectives that question the narrative created by modern comparative law: Third World Approaches to International Law, postcolonial studies of law, and critical comparative law.

The author

Daniel Bonilla Maldonado is Full Professor of Law at Universidad de los Andes in Bogotá. He holds an LL.M. and J.S.D. from Yale Law School and a law degree from Universidad de los Andes. He has been a visiting professor or lecturer at a number of institutions, including Yale Law School, Science Po - Paris Law School, Fordham Law School, Oñati International Institute for the Sociology of Law, University of Brasilia,  Fundacion Getulio Vargas - Sao Paulo, Georgia State University College of Law, and Universidad Nacional de Colombia. He is the recipient of a Fulbright Fellowship and several awards for excellence in teaching. Among his publications are Legal Barbarians: Identity, Modern Comparative Law and the Global South (Cambridge University Press, 2021); Constitutionalism of the Global South (ed.)(Cambridge University Press: 2013); La Función Social de la Propiedad (ed.) (Editorial de la Universidad de Buenos Aires, 2013); and La Constitución Multicultural (Uniandes-Siglo del Hombre, 2006).
