Divorcio e adultério face às distintas formas jurídicas no norte de Moçambique durante a primeira metade do século XX

The purpose of this presentation is to analyze how the discourses around divorce and adultery were present in the colonial courts in Northern Mozambique during the first half of the twentieth century, and how this reflected the conflicts of gender and sexuality existing within the African settlements and colonial relations. In that period, the populations of this region, those belonging to the Makua and Mwani peoples, experienced three different legal formats: local, Muslim, and Portuguese/colonial. The Makwa and Mwani were Muslims, had their social organization linked to matrilineal kinship relations and, increasingly, felt the weight of Portuguese colonial rule. Within this perspective, it also intends to understand how these legal formats were produced and produced different overlapping systems of oppression and identity.
