Spanish Abstract:
La entrada examina la voz “procurador” en el derecho canónico y civil entre los siglos XVI y XVIII, a través de fuentes normativas, doctrinales y prácticas, considerando sus particularidades americanas. Además de definir el oficio, clasificar sus tipos y distinguirlo de figuras semejantes, se localiza la actuación de los procuradores en la práctica jurídica indiana. El artículo inicia con una breve historia de la regulación normativa del oficio y su tratamiento por la literatura jurídica; luego se preocupa por su deslinde conceptual de las figuras del mandato y la representación. Seguidamente, analiza la representación corporativa y de personas vulnerables, las formalidades para su constitución, los sujetos habilitados para ejercerlo, sus atribuciones, honorarios y los motivos de expiración. Se acompaña con ejemplos empíricos de la práctica social indiana en cabildos, audiencias y la justicia episcopal. Al final se presenta una breve guía historiográfica.
English Abstract:
This entry examines the term "procurator" in Canon and Civil Law between the 16th and 18th centuries, drawing on normative, doctrinal, and practical sources, and considering its specific characteristics in Spanish America. In addition to defining the office, classifying its types, and distinguishing it from similar figures, the article traces the role of procurators in the legal practice of the Indies. It begins with a brief history of the normative regulation of the office and its treatment in legal literature; it then addresses its conceptual distinction from the figures of mandate and representation. In addition, it analyzes the representation of corporations and vulnerable individuals, the formalities for its establishment, the individuals authorized to exercise it, their powers, fees, and the grounds for its termination. Empirical examples of social practice in the New World, specifically in town councils, courts, and episcopal courts, are included. The article closes with a brief historiographical guide is presented
