Spanish Abstract: La capellanía era una fundación eclesial dirigida a la obtención de sufragios en favor de los difuntos, para que alcanzaran la vida eterna. En Hispanoamérica y Filipinas se arraigaron pronto y difundieron rápidamente hasta la era republicana. Su continuidad a lo largo de más de tres siglos exige un análisis de su estructura y del derecho que la sostuvo. El estudio se ha abordado desde la perspectiva de la libre configuración de la capellanía, de sus actores y de la normativa canónica y civil. El equilibrio de ambos derechos sobre la capellanía osciló entre la supervisión episcopal, amparada por la monarquía, y una intromisión cada vez más importante de esta última en el ámbito de las amortizaciones y bienes vinculados, que limitó la expansión de la figura canónica, hasta su extinción en las repúblicas independientes. No obstante, aún en el siglo XX, permanece puntualmente la institución, como muestra de la capacidad reactiva de las personas y de la creatividad del derecho, en pro de la libertad de elección del ciudadano.

English Abstract: The chaplaincy was an ecclesiastical foundation aimed at obtaining suffrages for the deceased, so that they could attain eternal life. In Spanish America and the Philippines chaplaincies soon took root and spread rapidly until the Republican era. Their continuity over more than three centuries requires an analysis of the structure of this institution and the law that sustained it. This study approaches the topic from the perspective of the free configuration of the chaplaincy, its agents and its regulations in canon and civil law. The balance of both normativities over the chaplaincy oscillated between episcopal supervision, protected by the monarchy, and an increasingly important interference of the latter in the field of amortisations and related assets of the chaplaincy, which limited the expansion of the canonical figure, until its extinction in the independent republics. Nevertheless, even in the 20th century, the institution still remains punctually, as an example of the reactive capacity of the people and the creativity of law, in favour of the citizen's freedom of choice.
